1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of Windows & Waves (the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, our Medical Disclaimer, and any other policies or guidelines we make available within the Service. If you do not agree, you may not access or use the Service.
2. Description of the Service
Windows & Waves provides tools for personal self-tracking, including but not limited to symptom tracking, medication logging, journaling, wave logging, daily check-ins, symptom reporting, and the generation of analytics and visualizations based on user-provided data.
The Service processes user-entered data to produce summaries, charts, report counts, educational displays, and insights across categories such as symptom logs, medication logs, wave logs, daily check-ins, and user-submitted symptom reports. Certain features, including basic tracking and data export, may be available at no cost, while additional features, including advanced analytics and enhanced export functionality, may require a paid subscription.
The Service may also include informational tools and content, such as medication-related information, tapering calculators, withdrawal symptom libraries, symptom report counts, and educational materials. All such content is provided for informational purposes only.
Windows & Waves does not verify the accuracy, completeness, or reliability of user-submitted data, symptom reports, aggregated counts, or generated outputs. The features and functionality of the Service may be modified, updated, or discontinued at any time without notice.
The Service may rely on third-party service providers to support functionality, hosting, data storage, payment processing, authentication, and other operations.
3. Not Medical Advice
Windows & Waves does not provide medical advice, diagnosis, or treatment.
The Service is provided for informational, educational, self-tracking, and self-reflection purposes only and is not a substitute for professional medical advice. Always consult a qualified healthcare provider before making decisions regarding medications, tapering, discontinuation, treatment, or health conditions.
User-submitted symptom reports, public report counts, educational summaries, and analytics do not prove that a medication, medication class, taper, missed dose, dose reduction, or discontinuation caused a specific symptom.
The Service is not monitored for emergencies. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately.

4. Eligibility
You must be at least 18 years old to access or use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement and that all information you provide is accurate and complete.
5. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to keep your account information up to date.
You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably determine pose a risk to the Service, other users, public report counts, or the integrity of user-submitted data.
6. Subscriptions & Billing
Windows & Waves offers both free and paid features. Core functionality, including data tracking, informational tools, and data export in table format, is available at no cost.
Certain features, including advanced analytics and enhanced export functionality, such as graphical exports in PNG or SVG format, are available through a paid subscription (“Pro”).
Pro is offered as a monthly subscription at a rate of $4.99 per month and will automatically renew on a recurring basis unless canceled prior to the next billing cycle.
Pro subscriptions may include a free trial period of 14 days. If not canceled before the end of the trial period, the subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.
From time to time, Windows & Waves may offer promotional access to Pro features, including access for invited feedback users. Such users may receive temporary access to Pro features at no cost for a specified period. Promotional access is granted at our discretion and may be modified or revoked at any time.
Billing and payment processing are handled by third-party providers, such as Stripe. By purchasing a subscription, you agree to the terms and conditions and privacy policies of such third-party providers. For more information, please review Stripe’s Terms of Service and Privacy Policy.
You are responsible for managing your subscription and canceling prior to renewal if you do not wish to continue. Except where required by law, all payments are non-refundable.
We reserve the right to modify subscription pricing, features, or eligibility for promotional access at any time, with reasonable notice where required.
7. Acceptable Use
You agree not to misuse the Service or use it in any manner that could harm, disrupt, or interfere with the operation of the Service or other users. Prohibited activities include, but are not limited to:
- Attempting to access accounts or data that do not belong to you
- Reverse engineering, decompiling, or attempting to extract the source code of the Service
- Interfering with or disrupting the integrity or performance of the Service
- Using the Service for any unlawful, harmful, fraudulent, misleading, abusive, or exploitative purpose
- Uploading or transmitting viruses, malware, or other harmful code
- Using automated systems, such as bots or scripts, to access, scrape, submit reports to, or interact with the Service in a manner that exceeds normal personal use
- Submitting false, abusive, duplicate, automated, misleading, or intentionally inaccurate data or symptom reports
- Attempting to manipulate public report counts, analytics, or educational displays
8. Your Content & Data
You retain ownership of the data you submit to the Service (“User Content”). You grant Windows & Waves a limited, non-exclusive, worldwide license to host, store, process, analyze, display, and use your User Content as necessary to provide, maintain, secure, and improve the Service.
User Content may include symptom logs, medication logs, wave logs, daily check-ins, journal entries, symptom reports, notes, and other information you choose to submit.
You are solely responsible for your User Content and represent and warrant that you have all necessary rights to submit such content and that it does not violate any applicable laws, third-party rights, or these Terms.
9. User-Submitted Symptom Reports
The Service may allow users to submit symptom reports related to medications, medication classes, tapering, missed doses, dose reductions, discontinuation, reinstatement, or other withdrawal-related contexts.
You agree to submit symptom reports only based on your own experience. You may not submit reports on behalf of another person unless the Service specifically allows it and you have the legal right to do so.
You agree not to submit false, abusive, automated, duplicative, misleading, or intentionally inaccurate symptom reports. We may limit one report per symptom per medication, medication class, or reporting context.
We may remove, exclude, suppress, or adjust reports from public counts, analytics, summaries, or displays if we believe they are fraudulent, duplicative, abusive, automated, submitted in error, inconsistent with these Terms, or otherwise likely to affect the integrity of the Service.
By submitting a symptom report, you grant Windows & Waves permission to process, analyze, summarize, display, aggregate, de-identify, and use that report for educational, analytical, product-improvement, safety, abuse-prevention, and reporting purposes.
Public symptom report counts are aggregated and are not intended to display your name, email address, or individual account information. However, report counts and analytics may be updated, corrected, delayed, or removed as the Service changes or as reports are reviewed.
Symptom reports and public report counts do not prove causation, incidence, prevalence, medical risk, or the likelihood that any individual will experience a symptom.
The symptom reporting feature is not monitored for emergencies. Do not use symptom reports to request urgent help, emergency support, diagnosis, treatment, or medical advice.
10. Content Use Policy
Use of public content, educational materials, symptom definitions, report counts, database-style pages, and other informational content made available through the Service may be subject to our Content Use Policy.
Unless otherwise permitted by that policy or by written permission from Windows & Waves, you may not scrape, bulk copy, resell, redistribute, extract datasets from, train artificial intelligence systems on, or commercially exploit public content, symptom libraries, report counts, or other database-style materials from the Service.
You may not use report counts, symptom pages, medication pages, or educational content from the Service in a way that falsely implies medical causation, official endorsement, regulatory findings, or clinical proof.
11. Intellectual Property
The Service, including its software, design, logos, name, branding, visual elements, educational content, symptom definitions, database structure, page layouts, and content excluding User Content, is owned by Windows & Waves or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, scrape, bulk extract, resell, or exploit any part of the Service without prior written permission from Windows & Waves, except as expressly allowed by these Terms or our Content Use Policy.
All rights in the Service not expressly granted to you are reserved by Windows & Waves.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, Windows & Waves disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Windows & Waves does not warrant that the Service will be uninterrupted, secure, or error-free, or that any data, analytics, symptom reports, public counts, educational content, or results generated by the Service will be accurate, complete, reliable, or medically applicable to your situation.
Windows & Waves is not an official adverse event reporting system, pharmacovigilance database, poison control service, medical regulator, healthcare provider, or emergency service.
13. Limitation of Liability
To the maximum extent permitted by law, Windows & Waves and its affiliates, officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, health-related outcomes, or use, whether incurred directly or indirectly, arising out of or related to your access to or use of the Service.
To the maximum extent permitted by law, the total liability of Windows & Waves for any claims arising out of or relating to the Service will not exceed the amount you paid, if any, to use the Service in the twelve months preceding the event giving rise to the claim.
14. Termination
You may stop using the Service at any time.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we reasonably determine it is necessary to protect the Service, its users, the integrity of symptom report counts, or public-facing information.
Upon termination, your right to use the Service will immediately cease. Windows & Waves will not be liable to you for any termination of your access to the Service.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and may provide notice within the Service.
By continuing to access or use the Service after such changes become effective, you agree to be bound by the updated Terms.
16. Indemnification
You agree to indemnify, defend, and hold harmless Windows & Waves and its affiliates, officers, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your User Content, your symptom reports, your violation of these Terms, or your misuse of public content, report counts, or educational materials.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, Medical Disclaimer, and Content Use Policy, constitute the entire agreement between you and Windows & Waves regarding the Service.
